Ibrahim Salih Al-Husseini: Do You mean that, is it permissible to a man testing the woman he wants to engage, or marry, before he marries her to make sure that she is free of AIDS, or not.
Questioner: Yes,
Ibrahim Saleh al-Husseini: It is permissible; there is no any matter with that. It is true that we can say trust in God and leave it off to him, but this is the period of wonders, and therefore; there is nothing wrong with examining. Especially, if it’s in a society where AIDS has spread like some countries in Africa, and countries in Europe where AIDS has spread. And AIDS is a serious disease; a disease which prevents our immunity, this disease is very dangerous, so there is no objection to testing a person, because the Messenger, may God’s prayers and peace be upon him, ordered one of the companions to look in the face of his proposed wife because there have something on the eyebrows from diseases, and therefore if it is permissible to see the disease in the eye, which does not mean lot, but rather distorts the beauty of a woman, then how is it not permissible to examine for a fatal disease such as AIDS which is a result of fornication, homosexuality and other things of sins and transgressions. It is permissible if a person did it, but it must have carried out of secrecy. Because, if you confront any woman and tell her, I must check you for AIDS before I marry you, she must tell you ‘No’ God have purified me out of that. The concept of my word is that it is permissible if this is agreed upon in Islamic community like societies in which we live. The test for all this is not good, because this is a useless act and it also involves a kind of ill thinking about the believers, just as we see here in Nigeria in some area as some men says: “The woman must be examined to see whether she is reproducing or not. Sometimes, this brought them to abandoning the following of Sunnah in the engagement and in marriage. Thus, the man would marry the woman and sit with her for years until she gave birth, then after that, marriage will be made with her, and if we asked some of the brothers in the Nigeria about this, they say ' No, we do not do this. Rather, the man comes to the daughter's father or her guardian and says, “Marry me, your daughter-in-law or your daughter,” and he says, “I married her to you” then he gives some of the money, then it is said to her, “You go and live with him.” Later, if she gives birth to children, marriage would be completed; if not he will expel her, a pejorative worse than a sin. We ask God for safety and success.
